
The city councilor of Votuporanga (SP), Serginho da Farmácia, proposed the creation of the Municipal Lottery during this week's City Council session. He intends for the activity to help increase revenue for investments in various areas, such as social assistance, sports, culture, health, and public safety.
In his justification, the councilor stated that the approval of his proposal would ensure an increase in municipal revenue without raising taxes, since the creation of a new economic activity would have very positive effects in addressing social assistance actions, human rights, and others aimed at the population of the city of Votuporanga.
According to the proposal, the city could explore any lottery modality provided for in Law 13.756/2018. “They can be explored by any possible means of sale, including electronic and online forms. The public service of the municipal lottery will be operated by the Executive, through the Municipal Secretary of Economic Development or by partnership, concession, or permission. All modalities to be explored by the Municipal Lottery will be regulated through their respective lottery plans”.
Serginho da Farmácia cited the decision of the Supreme Federal Court to propose the creation of the Municipal Lottery of Votuporanga: “The STF determined that the exploitation of lotteries has the legal nature of a public service, given the existence of express legal provision. In this sense, the Court declared that the exclusive competence of the Union to legislate on consortium systems and lotteries does not preclude the material competence to explore lottery activities nor the regulatory competence of this exploration”.
“For this reason, the material competence to establish lotteries within federal guidelines is guaranteed, even though such materialization may be expressed through state, district, or municipal decrees or laws. Ultimately, the legislation simply aims to facilitate the exercise of its material competence to establish a public service”, highlighted Serginho da Farmácia.
