The Philippine Department of Justice (DOJ) will seek clarification from the Office of the Ombudsman regarding whether the corruption charges against former Banban Mayor Guo Huaping were correctly filed in the Tarlac Regional Trial Court (RTC) instead of the anti-corruption court (Sandiganbayan).
Justice Minister Jesus Crispin Remulla told reporters that according to the law, cases involving lower-level public officials are under the jurisdiction of subordinate courts, while the anti-corruption court has original jurisdiction over senior officials.
He added, "There might have been an oversight, possibly a lack of careful examination as to why the case was filed in the RTC, when in fact, the mayor's salary grade is 30."
The government's Salary Grade (SG) 30 ranges from PHP189,000 to PHP211,000.
Remulla stated that allegations against employees with at least a salary grade of SG 26 should be filed in the anti-corruption court.
The Philippine National Police (PNP) has taken over the custody of the dismissed mayor following her arrest by the Capas Regional Court Branch 109.
