Governor Claudio Vidal enacted Law 3,872 which, in its Article No. 6, bans any type of advertising related to igaming platforms in the Argentine province of Santa Cruz.
Argentina.- The governor of the Province of Santa Cruz, Claudio Vidal, today enacted Law 3,872 which creates the "Provincial Plan for the Prevention of Gambling Addiction in schools and colleges" of the province. As highlighted in its text, the new law seeks to detect, prevent, address, and eradicate gambling addiction and problematic gaming in the educational environment of this Argentine province. Among the most decisive measures established by the law is the prohibition of advertising for igaming platforms throughout the territory of Santa Cruz.
Through the signing of Decree No. 922, Vidal enacted the Law 3,872 which was sanctioned by the Provincial Chamber of Deputies on August 8 of this year. The law understands "gambling addiction" as the pathological addiction to electronic or chance games, using any suitable means, and recognizes it as "a disease whose prevention, treatment, and eradication are of public interest insofar as this condition affects numerous dimensions of human life."
The most important measure incorporated through the enactment of the law is Article No. 6 which prohibits "throughout the territory of the province of Santa Cruz, any type of advertising, direct or indirect, by any means, aimed at the dissemination, promotion, incitement to the use of means and/or platforms intended for gambling. This prohibition includes advertising through brands, slogans, drawings, logos, symbols, mottos, corporate colors, sounds, music, or any other form of identification or distinction of the brand or company that aims at the commercialization of gambling."
In case of violation of this provision "the owner of the beneficiary platform and the owner and/or responsible of the commercial, industrial or service establishment or institution where the propaganda or advertising is carried out will be jointly and unlimitedly responsible."
