Fixed-odds betting and gaming companies who do not operate within Brazil’s new online gaming regulatory framework will soon be blocked.
The order comes via the latest ordinance from Brazil’s Prizes and Betting Secretariat (SPA), which has been setting out the landscape of the market ahead of its go-live on January 1 next year.
As of October 1, only legal entities offering lotteries that have submitted licensing applications to the Ministry of Finance – which the SPA falls under – will be allowed.
Those that do not form part of the new framework must allow players to withdraw funds from their online accounts by October 10.
If such companies do not comply, the SPA will – as of October 11 – proceed with the blocking and exclusion of applications that offer the service outside of the legislation and current regulations.
However, the SPA says companies are obliged to return funds to players whenever they request a withdrawal – “regardless” of the October 10 deadline.
Those companies that have joined Brazil’s online licensing process must notify the SPA by September 30 their active brand and internet domains where they will provide the service during the transition period.
“From January 1, 2025, only authorised betting operators will be able to explore the activity in the country, which will take place exclusively in a Brazilian internet domain, with the extension ‘bet.br,” the regulator said.
“The Prizes and Betting Secretariat will send a communication to the states and the federal district that operate the fixed-odds lottery betting modality, within their territories, under the terms of art. 35-A, of Law No. 13,756, of December 12, 2018, requesting the indication of the authorised brands in activity and their respective internet domains.”
