The Attorney General's Office (AGU) has filed an appeal with the Federal Regional Court of the 1st Region against a decision by the Federal District Court that authorized bets licensed only in Rio de Janeiro to operate nationwide. The AGU states that the security mandate from the DF in favor of Loterj not only invades federal jurisdiction, but also weakens the framework being set up to protect users of gambling and online betting.
In its request, the AGU claims that the judicial decision from the Federal District Court invades the Union's competence to define national rules for the exploitation of sports betting and online games. According to the AGU, the sector's legislation allows states to explore the activity only within their territories.
The AGU argues that the questioned decision causes "systemic effects that culminate in the compromise of the implementation of public policies that are necessary to mitigate the risks of gambling to the whole society".
Furthermore, the Attorney General's Office reinforces that the sector's legislation allows states to exploit the activity only in a limited way to the state territory.
The Ministry of Finance concluded the first phase of registration of sports betting houses and online games that want to operate legally and under supervision and published the list of those that can continue operating until December 31. Those not listed are prevented from operating and will be taken down by the National Telecommunications Agency (Anatel).
On the 30th, Loterj filed a security mandate to keep its bets on air and with permission to operate throughout Brazil. The next day, federal judge Antônio Cláudio Macedo da Silva ruled in favor of the State Lottery of Rio de Janeiro.
The first-instance court not only authorized the operation of these bets, but also suspended for them the effects of ordinances from the Ministry of Finance that regulate the activity nationwide.
The AGU also informs that the Loterj's notice "does not guarantee compliance with the legal requirement that the service has been performed in the territory of Rio de Janeiro, requiring only a declaration from the bettor that the bet was made in that state".
Thus, the following bets accredited by Loterj are authorized, until a new court decision:
