Project allocates part of lottery resources to rural credit

The Senate Economic Affairs Committee will debate next Tuesday (8) the Selective Tax established by the tax reform, proposed to discourage the consumption of products harmful to health and the environment. Among the guests are André Gelfi, president of the Brazilian Institute of Responsible Gaming, and Ana Helena Karnas Hoefel Pamplona, representing the National Association of Games and Lotteries. Abragames is also on the list.

The meeting is part of a series of debates requested by the chairman of the Committee, Senator Vanderlan Cardoso (PSD-GO), to support the working group coordinated by Senator Izalci Lucas (PL-DF) in evaluating the regulatory projects of the tax reform (Constitutional Amendment 132).

The project under review (PLP 68/2024), among other topics, provides for the replacement of five taxes (ICMS, ISS, IPI, PIS, and Cofins) with three: the Tax on Goods and Services (IBS), the Contribution on Goods and Services (CBS), and the Selective Tax, which will apply to products such as alcoholic beverages, cigarettes, high-sugar drinks, and combustion vehicles.

The tax reform also allows for the charging of 1% of the Selective Tax on the extraction of non-renewable natural resources, such as minerals and oil. The regulation of the Selective Tax may also reduce or zero the rates for some specific type of product, which will be determined by subsequent ordinary law.

Among the sectors identified as eligible for the application of the Selective Tax is that of sports betting and online games. Regulated this year, the sector was taxed at 12% on the GGR and with the other taxes incident on any commercial activity, it should reach a tax burden between 35% and 40%, one of the highest in the world.

* André Clemente Lara de Oliveira, counselor of the Court of Accounts of the Federal District (TCDF);

* João Hamilton Rech, tax auditor of the Federal Revenue of Brazil;

* Victor Bicca Neto, president of the Brazilian Association of Soft Drinks and Non-Alcoholic Beverages Industries (ABIR);

* Rinaldo Mancin, representative of the Brazilian Mining Institute (Ibram);

* Felipe Kertesz Renault, director of the Brazilian Association of Financial Law (ABDF).

Bets and social investment

Loterj continues to innovate, opening business perspectives and boosting the economy of Rio de Janeiro. Today, 11 betting houses are licensed to operate legally, which favors responsible gaming and job creation. 

With the regulation of bets and the return of the instant lottery modalities (Raspa Rio), relaunched on August 12, and of numerical/multiple chance prognosis (Rio de Prêmios), Loterj reinforces its institutional mission, prioritizing investments in projects directed at the most vulnerable layers of society.

In the last three years, the State Government has increased social investments nearly fivefold with resources from Loterj: R$ 1.5 million in 2022; R$ 4 million in 2023; and, from January to December 2024, more than R$ 7 million. This growth is proportional to the process of legalization of bets.

Bill 1658/23, already approved by the Senate, allocates part of the lottery revenue to finance rural credit. The text, now under review in the Chamber of Deputies, amends Law 13.756/18. According to the proposal, each year the net values collected in three sports modalities contests will be allocated to the National Land Credit Program (PNCF) and placed in the Land and Agrarian Reform Fund (Banco da Terra).

The National Land Credit Program offers financing lines for the purchase of rural properties or goods and services to structure agricultural production. The beneficiaries are small family farmers or rural workers.

According to the author of the proposal, Senator Jaime Bagattoli (PL-RO), the intention is to strengthen this type of financing. “The reality has shown that access to the PNCF has not been satisfactory due to the scarcity of resources”, he said.

Currently, Law 13.756/18 already allocates the income from three annual contests to the Brazilian Red Cross and to the federations of the Associations of Parents and Friends of Exceptional Individuals (Fenapaes) and of the Pestalozzi Associations (Fenapestalozzi).

The project is being processed conclusively and will be analyzed by the committees on Agriculture, Livestock, Supply and Rural Development; Finance and Taxation; and Constitution and Justice.

To become law, the text, which has already been approved by the Senate, must also be approved in the Plenary of the Chamber.
