A bill was introduced in the provincial House of Representatives. The proposal is similar to the legislation in force in Córdoba and Santa Fe.
Argentina.- The province of Entre Ríos does not have a law regulating online betting. This leads to the proliferation of illegal sites with the known risks this poses to the population, especially the younger ones, and how the State, in this case provincial, misses the chance to generate income in terms of taxes.
The ruling of the highest court was made under the system of general repercussion. Therefore, the understanding must be applied to all similar cases that are processed before the courts of the different Brazilian states, setting a precedent at the national level.
The case that originated the appeal involves a company from Fortaleza that wanted to explore lottery activities similar to those known as “Lotería de los Sueños”, a product offered by the Lotería del Estado de Ceará (Lotece). The request was initially endorsed by the State’s 11th Public Treasury Court. However, the Appeals Panel accepted the state's appeal and denied the authorization, under the argument that the exercise of the lottery activity, being a public service, must be preceded by a bidding process.
In the STF, the company argued that third parties already exploit the service without prior bidding and that the requirement of bidding in their case would establish unequal treatment.

Upon analyzing the appeal, Minister Luís Roberto Barroso affirmed the public service nature of lottery contests and, consequently, the requirement of a bidding process for its exploitation by private agents.
