The six pages blocked by the provincial justice did not have authorization from the Social and Financial Box, the regulator from San Luis.
Argentina.- The provincial justice ordered internet providers to block six unauthorized gambling websites that were operating in the province of San Luis. These platforms allowed users to register and gamble with money without the necessary authorization issued by the Social and Financial Box.
Judge of Guarantees No. 2, María Agustina Dopazo Samper, considered that these platforms generate uncertainty and insecurity among bettors due to the lack of legal support. The measure seeks to protect the health, safety, and economic interests of the citizens.
“The reported facts not only affect legitimate interests and rights corresponding to the jurisdictional scope but also generate uncertainty and insecurity among different bettors due to the lack of legal support that guarantees safety and transparency to the people participating in the activities proposed by the mentioned sites,” stated prosecutor Ricardo Barbeito to Dopazo Samper.
In the resolution, which extends for 11 pages, the magistrate understood that the precautionary measure refers to “stopping the commission of the crime or its effects or preventing the consolidation of its benefits or obstructing impunity”.
“The investigation and the current request carried out by the Fiscal Approach Unit inherently aims to prevent the crime committed from producing further consequences, avoiding that the deeds are carried to their ultimate effects. Likewise, and as prescribed in article 42 of the National Constitution, I understand that it is necessary to guarantee to the citizens consumers and users of goods and services the rights to the protection of their health, safety, and economic interests,” she indicated.

And she added: “I understand that waiting to have streams of evidence that further nourish the verisimilitude, to the point of expecting to have an almost advanced cause, I perceive it as an unforgivable delay that would expose the victims and society to a state of defenselessness, depriving them of the issuance of measures of this nature.”

Dopazo Samper understood that “the criteria necessary to consider the verisimilitude of the right in terms of the gravity referenced in the request and described by the presenting bodies are met, which claim the sole purpose of safeguarding fundamental rights that, if not protected immediately, will be of impossible subsequent repairability and -on the other hand- the danger in the delay that if the requested precautionary measure is not granted, there is evidently a certain possibility that more events like the ones reported may unfortunately occur at any time.
