Jorge Hinojosa, general director of the Spanish Digital Gaming Association, spoke about the possibility of applying more limitations to gambling advertising.
Spain.- As a proposal from the Spanish government to create the National Public Health Agency progresses, which would include, among other points, advertising limitations in the gaming industry, the Spanish Digital Gaming Association (Jdigital) explained that there is no “urgency or necessity” to limit the advertising possibilities of operators.
According to the Spanish press, this proposal would modify the Law 13/2011, of May 27, on the regulation of national gaming, with the aim of including advertising limitations, prohibiting welcome bonuses and promotions, and more.
In this context, Jorge Hinojosa, general director of the Spanish Digital Gaming Association (Jdigital) spoke with the local media Democrat and noted: “If we eliminate the possibility of making known the legal operators we fear that it facilitates access to illegal operators”.
Hinojosa highlighted that the government had already imposed these restrictions with the Royal Decree 958/2020 on Communications, which was subsequently repealed by the Supreme Court ruling 537/2024.
Now, they are trying to return to these conditions, which include “limiting the advertising of gaming to a series of spaces” and only allowing commercial communications “on video exchange services through platform, social networks, at sporting events, on advertising posters located at the aforementioned events and whose results are subject to betting and in the development of television contests”.

Thus, the general director of Jdigital considered that the industry is already self-regulated through the Code of Conduct on commercial communications of gaming activities. Hinojosa insisted that the Government, with the amendment, “is using a tool that is too powerful” and, moreover, “is not taking into account that it is applying a text from 2020 to 2022”, so some issues are outdated or are already addressed in the aforementioned Code of Conduct.
