Online gaming and sports betting in Peru: there are already more than 60 companies authorized to operate

Licenses are granted by the Ministry of Foreign Trade and Tourism (Mincetur).

Peru.- More than six months after the enactment of Law No. 31557, which Regulates the Exploitation of Remote Gaming and Remote Sports Betting in Peru, the Ministry of Foreign Trade and Tourism of Peru (Mincetur) reported that a total of 67 brands have received authorization to operate in the market in a regulated manner.

According to the updated report of Exploitation Authorization Holders, the 67 authorized brands correspond to 64 companies.

At the end of March this year, the process began for various operators, both local and international, to apply for their license. 

Mincetur, the body responsible for regulating online gaming, opened the deadlines to receive the corresponding authorization applications. Since then, operators had to comply with an extensive series of steps, including the submission of documentation, registrations, and other required requirements. Mincetur meticulously evaluated each case and granted the license if everything was in order. It could also demand modifications, request more documentation, or simply reject the application.

During the first 30 days of the enactment of Law No. 31557, 145 authorization applications were submitted by national and international companies to participate in this activity.

Furthermore, it was reported that during that period, 144 service providers linked to the sector were registered and seven international certification laboratories were accredited, and the providers submitted 184 applications for homologation of technological platforms, gaming programs, progressive systems, and gaming modalities.

Law 31557 states, among various aspects, that Mincetur is the national administrative authority that regulates, authorizes, revokes, supervises, and sanctions the exploitation of remote games and remote sports betting. 

The legal provision maintains that only natural persons of legal age, of Peruvian or foreign nationality, previously registered on the technological platforms of the authorized remote games or sports betting, can participate in this activity.

In the case of remote sports betting game rooms, they may be located in a venue exclusively for this activity or others whose main business is the sale of other products or services. 

Regarding betting, the new law indicates that the player must make the payment of their bets with circulating money, credit cards, debit cards, or any other means of payment, except for cryptocurrencies. 

The companies authorized since April 1 are subject to the tax on games and remote sports betting. This tax is 12 percent of their revenues.

It is estimated that under this regulation the Peruvian State will be able to collect about S/ 162m (USD43.5m) annually, to be invested in the reactivation of tourism, infrastructure works for tourism, promoting sports, and addressing mental health programs.
