Symposium of OAB SP emphasizes the importance of regulating bets with a focus on responsible gaming

The word responsibility was the focus at the 1st Symposium on Gaming Law, Betting, and Responsible Gaming of the Brazilian Bar Association São Paulo Section (OAB SP). The event featured Regis Dudena, Secretary of Prizes and Betting (SPA), who participated in the opening panel. He defended the importance of regulation and measures to encourage adherence to international best practices and to combat fraud. GLI, OKTO, Rei do Pitaco, and Conar also made their contributions to the debates.

Regis Dudena presented a history of the creation and structure of the secretariat, due to the Regulation Law. “Indeed, the Brazilian State is preparing to have a regulatory body and a framework to deal with the gaming sector”, he highlighted. 

From eleven topics scheduled in the regulatory agenda, we created 10 ordinances and there was some skepticism that the deadline set back then would not be met, but it was”, he added.

The secretary touched on several points that were developed throughout the day by other panels, such as payment methods, taxation, compliance, and advertising of the new market, and responsible gaming, with devices to prevent addiction and indebtedness of the bettor, focusing on the responsibility of the operators. 

Regulation is aimed at the betting agent. He is the first controller of his interaction with the bettors. We have operators willing to do things within the law, others willing to exhaust the resources of the bettors and also those willing to commit fraud. Those who remain will have duties: it is the duty of the operator to have a responsible gaming policy, which will be evaluated”, he concluded.

 



The day featured the panel “Legal and Regulated Gaming”, moderated by José Francisco Manssur, from the Gaming Law Committee, OAB SP. He led the debate accompanied by Ana Bárbara Costa Teixeira, Director of Regulatory Affairs for Brazil at Ocean 88 Group and consultant of the National Association of Games and Lotteries (ANJL); Ana Helena Karnas Hoeffel Pamplona, co-founder of the Association of Women in the Gaming Industry and the Brazilian Institute of Gaming Law; and Neil Montgomery, Master in International Law by USP.

 

 

Mariana Chamelette, from the Gaming Law Committee of OAB SP, returned to the panel for “Clean and Safe Gaming - Integrity and Compliance”, which featured Rafael Edelmann, Director of Governance, Risks and Compliance at OKTO for Brazil; Andrea Ueda, Master and PhD in Law by USP; and Gustavo Delbin, from the Gaming Law Committee of OAB SP.

The afternoon sessions were opened by Luiz Felipe Santoro, with the panel “Challenges of Conscious and Responsible Gaming”, with Rafael Ávila, psychologist post-graduated in Cognitive-Behavioral Therapy PUC-RS and executive director of SOS Player and member of the Gaming Law Committee of OAB SP; Victoria Cerioni, head of iGaming and Innovation at Sadi Morishita Lawyers, associate member of the Contracts and Admission Committee of the Association of Women in the iGaming Industry and also of the Gaming Committee; and Raquel Zenedin, specialist in Compliance by Insper and director of Compliance at Todos Querem Jogar (TQJ).

 



The productive discussion also had a last panel, moderated by Simone Vicentini: “Perspectives of the Regulated Market”, which featured Rafael Marcondes, president of the Brazilian Association of Fantasy Sport and legal director of the Brazilian Institute for Responsible Gaming (IBJR); Valter Delfraro Júnior, executive of Government Relations and Business Development at GLI Brazil; and Juliana Albuquerque, Executive Vice-President of Conar (National Council for Self-Regulation in Advertising).
