The class will present one of the topics that has been most active in the gaming and betting market in Brazil. In October, the Attorney General's Office (AGU) approached the Supreme Federal Court (STF) to prevent betting houses authorized by the State Lottery of Rio de Janeiro (Loterj) from operating nationwide. At the time, the federal government issued a statement, explaining that this activity exceeds Loterj's competence and violates norms of the Ministry of Finance, as well as interfering with the Union's exclusive attribution to regulate this sector.
“The main points of ongoing actions in the STF, such as ADI 7721, proposed by the National Confederation of Commerce, ADI 7723, proposed by the Solidarity Party, and ACO 3696, filed by the AGU against the national operation of bets accredited by Loterj”, highlights Fabiano Jantalia.
“All these actions discuss, in one way or another, the limits of each federal entity's operation in the gaming and betting market and can strongly impact the dynamics between the Union, States, Federal District, and Municipalities when it comes not only to the exploitation of fixed quota lotteries but also to the regulation and structuring of this market in Brazil", adds the expert.
Brazil is considered one of the three countries that most move the sector. Data released by the Central Bank of Brazil indicate that Brazilians moved about R$ 54 billion between January and November 2023 in games and bets on sports betting platforms.
