Sports Betting in Brazil: the Supreme Federal Court convened an extraordinary virtual session to analyze the decision of Luiz Fux

The meeting will be held today to evaluate the magistrate's decision to ban the use of money from social benefits in online betting and to regulate advertising provisions.

Brazil.- The Supreme Federal Court (STF) will analyze in a virtual plenary session today the decision of Minister Luiz Fux which orders the federal government to ban the use of money from social benefits, such as Bolsa Família, in online betting. Additionally, it urges the government to immediately implement the rules established in a federal government ordinance that prohibits advertising on betting sites targeted at children and adolescents.

In a dispatch issued early in the afternoon of Wednesday, November 13, the minister requested the president of the Supreme Federal Court, Luis Roberto Barroso, to set a date for a referendum with the decision of the other ministers.

The resolution, unlike others that are developed in a virtual plenary, will last only 1 day. Lawyers working on the case will have until 10:59 AM to present their statements. According to Barroso, the request was accepted due to "the exceptional nature of the case."

In the same decision that motivated this resolution, Fux highlighted that the rules established in a federal government ordinance that prohibits advertising on betting sites targeted at children and adolescents must be applied immediately. The minister established that the rules of the Ordinance 1.231/2024, regarding the prohibition of advertising on betting sites targeted at children and adolescents, must be applied immediately. Initially, the actions of the ordinance would come into effect in 2025.

Fux also decided that the federal government, through the Ministry of Finance, must adopt measures of "special protection" to prevent the use of resources from the fixed quota online betting assistance program. The determination encompasses, for example, the benefits paid by Bolsa Família and BPC (Continuous Payment Benefit).

In the order, Fux states that there are "evidence of the relevant and harmful impacts that advertising of betting currently has on the mental health of children and adolescents" and "the bets on family budgets, particularly of those benefiting from social and welfare programs."
