Sports Betting in Brazil: Proposal to Ban Betting on Individual Events in Football Matches

The Justice of the Supreme Federal Court, Flávio Dino, seeks to veto bets on any action that depends on a player's decision, such as cards, fouls, and other minor incidents.

Brazil.- The Full Bench of the Supreme Federal Court (STF) voted and unanimously approved the precautionary measure by Minister Luiz Fux that prohibits, nationwide, the use of social program funds, such as Bolsa Família and BPC, in sports betting, as well as imposing restrictions on the advertising of online games that could reach children and adolescents.

The decisions were ratified during the extraordinary virtual session, last Thursday, November 14. During the meeting, Minister Flávio Dino took the opportunity to propose the creation of a rule that prohibits betting on individual activities in sports events, that is, any action that depends on a player's decision, such as cards, fouls, and other smaller moments in a match.

Dino stated that the Ministry of Finance and the Ministry of Sports would be responsible for creating this rule. "At stake is the very concept of betting, which cannot be undermined by the individual will of a person who intentionally produces an event that generates profits for a few and losses for many," affirmed the STF minister.

Dino's arguments are in line with those expressed by the Brazilian president, Lula da Silva, who last week voiced his support for the proposal by Senator Jorge Kajuru for the government to prohibit, by decree, bets related to yellow and red cards, throw-ins, penalty shots, and corner kicks in soccer matches.

According to the project presented by Kajuru to prevent illegal situations and match-fixing, this type of betting would be prohibited and only betting on the final result of the matches would be allowed.

The statements were made during an interview with Kajuru and Senator Leila Barros on the PODK Liberados program. It is in this conversation that the Brazilian president supports the Senator's idea by citing the case of Flamengo player Bruno Henrique.

In another order of things, Dino complemented his speech by arguing that the responsibility to prevent pathological gambling should not fall on the Ministry of Finance, as current legislation foresees, but on the Unified Health System (SUS), as it is the constitutionally competent body for public health issues.
