The Secretary of Awards and Betting (SPA) published this Tuesday (26) the Ordinance 1.857/2024, which regulates the transfer of data and resources of bettors between legal entities of the same economic group. By the measure, both the sending and receiving company must be licensed by the SPA to explore sports betting and online gaming.
The transfer of data and resources from bettors registered in the sending legal entity to the receiving legal entity can only be carried out between bets of the same economic group.
To receive the data and resources of bettors registered in national or foreign legal entities of the same economic group, which explore the fixed quota lottery betting modality in the national territory, they must request approval from the Secretary of Awards and Betting of the Ministry of Finance.
The receiving bet of the data and resources must formalize the request for approval to the SPA by filling out a specific requirement and sent through the Electronic Information System of the Ministry of Finance.
The transfer of data and resources approved by the Secretary of Awards and Betting of the Ministry of Finance must observe the following requirements:
I - the transfer of data and resources to the receiving legal entity must have been previously and expressly consented to by the bettors of the sending legal entity;
II - the identification and registration of bettors in the sending legal entity must comply with the provisions of Ordinance SPA/MF No. 722, dated May 2, 2024, and Ordinance SPA/MF No. 1.231, dated July 31, 2024;
III - the transferred data to the receiving legal entity must be stored and treated in accordance with the rules of Ordinance No. 722, dated May 2, 2024; and
IV - the resources of each bettor must be properly identified in the sending and receiving legal entity by the registration number of the holder in the Individual Taxpayer Registry - CPF.
Bettors will be assured the right to choose between:
I - withdrawing the resources of their ownership by sending them to one of their registered accounts in a financial institution or payment institution authorized by the Central Bank of Brazil; or
II - authorizing the transfer of the resources of their ownership to a transactional account in the receiving legal entity, with respective registration in the graphic account.
Bets that have not requested authorization to explore sports betting and online games until September 17 will not be able to make transfers between companies of the same economic group.
The Ordinance also determines that companies that have not obtained a license to operate sports betting and online games close all open bets by December 31, 2024, transferring the available resources to the current account registered on the platform by the bettors.
In the event that bettors have not indicated an account for receiving resources and after attempts by the company to return the values until March 31, 2025, all values must be reverted to the Student Financing Fund and the National Fund for Public Calamities, Protection and Civil Defense.
