The National Consumer Secretariat (Senacon), linked to the Ministry of Justice, has positioned itself against the adaptation period for bets. In a technical note attached to the administrative process on online betting games, the department argued that the interpretation of the period provided in the current legislation is 'unfounded' and would presuppose the 'hermeneutical absurdity of fixing the understanding that in six months no one becomes addicted'.
The document cites the Bets Law, signed by Lula in December 2023, and Ordinance No. 1.475, from the Secretariat of Prizes and Bets (SPA), of the Ministry of Finance, which established the conditions for companies to participate in the transition period of the regulation to explore the service.
The technicians from Senacon write:
"It is neither reasonable nor rational to understand that the same law that does not admit the bonus, because it generates addiction and dependence, tolerates it for six months so that companies can adapt to the legal prohibition. This would presuppose the hermeneutical absurdity of fixing the understanding that in six months no one becomes addicted. And even if it were not so, such interpretation would also not be authorized in light of what the Consumer Defense Code provides".
According to the Ministry of Finance, the disclosure of the list of 100 companies with respectively 219 bets that can continue operating until the end of the year was based on this ordinance.
Therefore, the adaptation phase to the new rules created for companies that requested authorization, through the Betting Management System (Sigap), until the date of publication of the ordinance, demonstrating interest in properly following the regulation and legislation.
