The Secretary of Awards and Betting published this Friday (6), Ordinance 1.902/2024, which deals with the anticipation of advertising rules previously contained in another legal document. With this, the agency complies with the Supreme Federal Court, which determined the immediate application of restrictions to sports betting houses and online games.
To comply with the preliminary decision determined in the Direct Actions of Unconstitutionality 7721 and 7723, of the Supreme Federal Court, the Secretary of Awards and Betting (SPA) of the Ministry of Finance edited this Friday (6) the Ordinance SPA/MF No. 1.902, which provides for the immediate application of rules provided in Ordinance 1.231.
The Ordinance defines the immediate application of clauses XVI, XVII, XVIII, and XIX of art. 12, which prohibits communication actions, advertising, and marketing of fixed quota betting lotteries directed at children or adolescents or that have this audience as their target.
The new document also prohibits their broadcast in media or in programs where people under eighteen constitute the main audience or on websites with a profile of an audience of minors.
It is also forbidden to use images of children and adolescents or elements particularly appealing to those under eighteen. Moreover, the norm prohibits that the communication of bets be associated with cultural activities for children and adolescents.
From now on, any type of communication of advertising, propaganda, and marketing by the bets, in any medium, must adopt the age restriction warning with the symbol 18+. Or the notice that it is “prohibited for minors under 18 years old”.
The rules of supervision, monitoring, and sanction for non-compliance with the provisions indicated in the heading, including those provided in arts. 19, 21, and 22, will be implemented by the Secretary of Awards and Betting immediately.
The others will be supervised, monitored, and sanctioned by the SPA starting January 1, 2025.
