The ordinance (Portaria SPA/MF Nº 2.104) lists 52 companies that have received provisional authorizations to operate in the sports betting and iGaming market. These authorizations were granted to brands that have met the requirements, including the payment of a grant of R$30 million, but have pending issues that can be resolved. The pending issues may be documents related to the certification of the betting system, online games and their integration, or the need for specific supplementation of documents or information.
Companies with provisional authorizations have a deadline of 30 days, extendable by another 30 (if they present the necessary justifications included in the ordinance), to deliver the mandatory technical certificates, such as those for the security of systems and game servers.
If they fail to comply, they may have their authorizations suspended for up to 90 days and if non-compliance continues, their authorization will be definitively revoked, preventing them from operating.
Important deadlines for companies with provisional authorization
Ordinance SPA/MF nº 2.104/24 establishes deadlines and procedures for the supplementation of certifications and documents related to the exploitation of sports betting and online games for companies that have obtained provisional authorization.
Here are the main points:
1. Certification supplementation
- Refers to technical certificates and betting systems (Sportsbook), Remote Game Server (RGS) and Integration, as per items 1, 2, and 4 of Annex VI of Ordinance SPA/MF nº 300/24, as provided in art. 14, clause V, of Law 827), as per art. 3º of Ordinance SPA/MF nº 2.104/24
- Deadline: 30 days from the publication of the ordinance.
- Extension of deadline: Allowed once for the same period, upon application accompanied by a declaration from the certification laboratory attesting the need for extension to conduct tests and issue certificates. Non-compliance will result in suspension for ninety days. Exploitation of sports betting and online games prohibited during the suspension.
- In case of non-compliance with the suspension period, revocation of the provisional authorization and definitive archiving of the administrative process.
2. General supplementation of documents
- Related to the requirements of art. 14, clauses II, III, IV, and VI of Law 827, as per. art. 2º of Ordinance SPA/MF nº 2.104/24.
- Deadline: thirty days from the notification sent by the Secretariat of Prizes and Bets.
- Penalty for non-compliance: Revocation of the provisional authorization and definitive archiving of the authorization administrative process.
3. Presentation of Online Game certification and Live Game Studios
- Refers to the technical certificates covered by items 3 and 5 of Annex VI of Ordinance SPA/MF nº 300/2024
- Deadline: thirty days after the publication of the ordinance.
- During the period, only online games, including live studios that meet the requirements of Ordinance SPA/MF nº 1.207/24 and that have been duly certified (i) under the terms of items 3 and 5 of Annex VI of Ordinance SPA/MF nº 300/24 or (ii) for another jurisdiction and based on international rules, by a certifying entity with operational capacity recognized by the Ministry of Finance.
