Arkansas: Fight over Pope County casino set to be heard in federal trial

A bench trial has been set to determine whether an amendment voters approved to the Arkansas Constitution is constitutional.

Arkansans approved Issue 2 in November.

Issue 2 repealed the license for a planned casino in Pope County. In order for another casino to ever open in Arkansas, the casino would need approval in a future statewide election and then additional voter approval in the specific county where the casino would be located.

The Cherokee Nation is suing, saying that the casino was approved legally back in 2018.

In 2018, 54% of Arkansas voters approved an amendment that allowed four casinos to be built in the state.

According to the Arkansas secretary of state’s office, 60% of voters in Pope County voted against the casino measure.
