There are new filings in the legal debate surrounding the Linn County gaming license decision by the Iowa Racing and Gaming Commission [IRGC].
Riverside Casino and the Washington County Riverboat Foundation are continuing their efforts to stop the construction of the Cedar Rapids casino. The IRGC approved a license for Linn County last week in a 4-1 vote.
The legal team claims in court documents that the IRGC was mainly considering the positive impacts for Linn County when making the license decision, and the commission did not consider the negative impacts on surrounding casinos.
“The IRGC’s issuance of a license for the Linn County Casino is a gross abuse of authority, unlawful, and unreasonable. The Court should prevent this abuse of power and unlawful act,” court documents in a motion for judicial review from Riverside say.
