Aviator LLC won a trademark and copyright lawsuit worth $330 million against Spribe OÜ and Flutter's Adjarabet, for using Aviator's name and logo in their popular crash game of the same name.
The District Court of Georgia, USA, found Spribe guilty of copyright and trademark infringement, declaring their trademark registration invalid, thus ordering Aviator LLC a compensation of $330 million.
During 2021-22, Spribe registered its Aviator trademark for computer games and gambling services. The Aviator game later became one of the most popular crash games on the market (if not the most popular), as discussed in the May/June issue of "Gambling Insider" magazine, and hosted on the Adjarabet website, one of the largest online casinos in Georgia.
Aviator sued the Georgian Flutter subsidiary for two reasons. First, Spribe maliciously registered its trademark despite knowing about the Aviator brand; second, these registrations infringed Aviator's copyrights. As part of the lawsuit, Aviator also sought to prevent Adjarabet from using its copyrighted material in the "Aviator" crash game.
On August 20, the court ruled in favor of Aviator LLC. In addition to the $330 million compensation claim, the court also declared Spribe's trademark invalid and ordered Adjarabet to stop using the "Aviator" name in its flagship game.
The law firm representing Aviator LLC is Mikadze Gegetchkori Taktakishvili LLC. Managing partner Nikoloz Gogilidze stated: "We are satisfied with the court's decision in this case, and we will continue to actively protect our client's intellectual property rights, preventing unauthorized use on any international gaming platform."
