The Sports Commission (CEsp) of the Senate may vote on Wednesday (4) the Bill 6.118/2023, which allocates resources from lottery revenues to electronic sports. Authored by Senator Izalci Lucas, the bill has already passed through the Economic Affairs Committee (CAE) and may proceed to the Chamber of Deputies if approved by the senators.
The proposal amends Law 9.615, of 1998, to include the Brazilian Confederation of Games and Esports (CBGE) in the National Sports System, which aims to promote and enhance performance sports practices.
Additionally, it amends Law 13.756, of 2018, increasing from the current 4.36% to 4.40% the percentage of resources from numerical prognosis lotteries allocated to sports. This increase of 0.04 percentage points in the collection should be entirely allocated to the CBGE.
Currently, other sports entities receive percentages collected by the lotteries such as the Brazilian Olympic Committee, which receives 1.73%; the Brazilian Paralympic Committee, with 0.96%; and the Brazilian Committee of Clubs, which receives 0.46%.
The rapporteur of the project in the CEsp is Senator Rodrigo Cunha (Podemos-AL), who has not yet presented his opinion, but he also reported on the matter in the CAE, where he expressed support for Izalci Lucas's initiative (PL-DF).

The State Bank of Sergipe (Banese) selected the consortium formed between Culloden Participações and TSA Informática to explore the state lottery. From now on, the process advances to the negotiation phase, which includes due diligence and discussion of corporate instruments, to jointly operate the business. The contract provides for passive, specific, numeric and sports prognosis, instant, and fixed quota modalities, in physical and digital media.
“Banese will keep its shareholders and the market informed about the developments of the initial negotiation stage, whose formation of the joint venture is subject to the approval of regulatory bodies”, the bank reports.
Banese will continue to inform its shareholders and the market about the progress of the negotiations, in compliance with the regulations of the Securities and Exchange Commission (CVM). The operation is part of the bank's strategy to diversify its activities and explore new growth opportunities in the Sergipe market.
For the implementation of the lottery, the law determines that the bank may choose to create a subsidiary, a holding company, or participate in a corporate structure to explore such services. The supervision of these new services will be under the responsibility of the Public Services Regulatory Agency of the State of Sergipe (Agrese).
In March of this year, the Legislative Assembly of Sergipe approved Bill 77/2023, which authorizes Banese to plan, organize, and explore the public lottery service, on behalf of the State Executive Power. The proposal aims to raise funds to be applied in social actions, culture, and the environment.
The author of the indication that proposed to the State Government the regulation of the public lottery service in Sergipe, the state deputy on leave and current Secretary of State-Chief of the Civil House, Jorginho Araujo, explained that another law (8.902/2021), already established the right of the state to adopt initiatives to enable its respective provision of lottery services through its own criteria.
“In September 2020, the STF understood that the exclusive exercise, by the Union, of lottery activities was unconstitutional. The old monopoly, today can be exercised concurrently by the States, allowing them to manage their own lotteries, applying the same rules already used by the Union”, emphasized Jorginho Araujo.
Banese launched, in May the Expression of Interest Procedure (PMI) 04/2024 in search of a partner for the exploration and operation of lotteries. The contract will last for 20 years and provides for passive, specific, numeric and sports prognosis, instant, and fixed quota modalities, in physical and digital media.
At the end of July, the State Bank of Sergipe began to analyze the proposals received in the PMI and on this Monday (2), indicated the option for the consortium formed between Culloden Participações and TSA Informática to advance to the negotiation phase, which includes due diligence and discussion of corporate instruments, to explore and jointly operate the lottery business in the state.
The decision was based on a competitive process conducted by PwC, which evaluated the proposals of the candidates.
