In another chapter of the regulation of betting houses in Brazil, the Brazilian Football Confederation (CBF) sent a new letter to clubs and federations, stating that bets accredited by the State Lottery of Rio de Janeiro (Loterj) can maintain advertising on team shirts and in football championships in the country. The entity had sent a notification last week in which it specified that these brands would be restricted to the state scope.
This allows Esportes da Sorte, the main sponsor of Corinthians and Bahia, as well as the Palmeiras women's team, to maintain their business in football. The document sent by the CBF to the clubs lists the companies that are permitted to operate at national and state levels, but makes an exception for brands affiliated with Loterj.
“Finally, except for the companies authorized by the State Lottery of Rio de Janeiro (Loterj), due to the provisions of article 35-A, paragraph 8°. of Law No. 13.756/2018, as amended by Law No. 14.790/2023, and if others also come to have such right secured, in court or by the Ministry of Finance, the other companies authorized by other States to explore fixed quota bets can only advertise or commercial propaganda within the limits of their territory, according to article 35-A, paragraph 4°. of the said Law”, says the excerpt from the document, which Estadão had access to.
Thus, Corinthians should have the sponsorship of Esportes da Sorte in the duel with Athletico-PR, scheduled for next Thursday (17) for the Brazilian Championship. The team from Paraná was also sponsored by the betting house, but terminated the link after the company was not regulated nationally last week.
The national list of companies that can operate until December 31 includes 96 companies that manage 213 bets. The list of those authorized to operate in the States has 18 companies. It is possible to consult all of them on the Ministry of Finance website. It is a period of adjustment. Only from January 1 will the definitive list of bets authorized to operate in Brazil be disclosed.
Corinthians did not officially comment on the topic last week. However, this Friday, it released a note confirming that the commercial relationship with Esportes da Sorte will continue. It also mentions a “judicial decision obtained by the partner, which is under secrecy of justice”.

The Sport Club Corinthians Paulista informs that, under the terms of the current legislation, it is authorized to continue with the exposure of the brand Esportes da Sorte, according to the current contract, which continues to be fully complied with by the parties.
The Club is also supported by a judicial decision obtained by the partner, which is under secrecy of justice, ratifying the authorization for the advertising of the brand.
What do the sections of the law, cited by the CBF, say?
The CBF bases itself on Law No. 13.756/2018 in allowing Esportes da Sorte, as well as other brands linked to Loterj, to maintain their sponsorship contracts with clubs. In paragraph 4 of the law, it is described that companies authorized at the state level can explore fixed quota bets and advertise or commercial propaganda only within the limits of their territory.
A decision from the 8th Civil Court of the Federal District had allowed the operation throughout Brazil of betting houses accredited by Loterj. However, understanding that the resolution invaded Union attributions, the AGU requested and obtained the suspension of the injunction from the Regional Federal Court of the 1st Region (TRF1) last Saturday. Thus, bets accredited by the entity can operate only in Rio and not throughout Brazil, as is the case with Esportes da Sorte.
However, in paragraph 8, there is a caveat:
“All concessions, permissions, authorizations, or direct exploitations promoted by the States and the Federal District from authorizing procedures initiated before the publication of Provisional Measure No. 1.182, of July 24, 2023, are preserved and confirmed in their own terms, understood as those whose first public notice or corresponding public call was published on a date prior to the edition of the said Provisional Measure, regardless of the date of the actual conclusion or issuance of the concession, permission, or authorization, respecting the acquired right and the perfect legal acts.”
Loterj had accredited before MP 1182, which establishes new rules for lotteries at the federal and state levels, in April 2023. The brand understands that, even though the injunction was revoked, it is secured in the terms of the law. This issue had also been pointed out in the injunction obtained by Loterj at the beginning of October.
