It was published in the Official Gazette this Tuesday (19) a dispatch from the National Consumer Secretariat prohibiting any advertising of rewards related to advance payments, anticipation, and bonuses offered by bets. The measure also suspends online gambling advertising for children and adolescents. The decision applies to all companies authorized by the Secretariat of Prizes and Bets. Non-compliance with the measure will result in a daily fine of R$ 50,000.
The purpose of the precautionary measure of the National Consumer Secretariat (Senacon), linked to the Ministry of Justice, is to monitor “the online games and betting market regarding bonuses and the advertising of betting games to prevent and combat over-indebtedness and also ensure the safety of vulnerable people in consumer relations, with special attention to the hypervulnerable such as children and adolescents".
The measure determines:
1 – Suspension throughout the national territory, of any advertising of rewards related to advance payment, anticipation, bonus, or prior advantage, even if merely for promotion, dissemination, or propaganda, for betting;
2 – Suspension throughout the national territory, any advertising of fixed quota online betting games (bets) for children and adolescents;
3 – Presentation, within a period of 10 (ten) days from the knowledge of the precautionary decision, a transparency report on the measures adopted to comply with the respective suspensions.
The companies in activity, authorized to explore fixed quota bets, national and state, as per the list published by the Secretariat of Prizes and Bets of the Ministry of Finance, must comply with the determination.
Non-compliance with any of the listed measures subjects the interested parties to the imposition of a daily fine in the amount of R$ 50,000 for non-compliance, which will accrue until the full compliance of the measure.
