SBC Summit Latinoamérica is gearing up for its final edition at the Seminole Hard Rock with more than 4,000 attendees.

Luiz Fux, a member of the highest judicial body, confirmed the constitutionality of the States to explore and regulate their lottery activities. The trial, which was supposed to end on October 25, was postponed.

Brazil.- Luiz Fux, minister of the Supreme Federal Court (STF) and rapporteur of the Direct Action of Unconstitutionality (ADI) 7640, voted in the Virtual Plenum for the unconstitutionality of paragraph 2 of art. 35-A of the Federal Law No. 13.756/2018 (included by the Federal Law No. 14.790/2023) and the "advertising expression", provided in paragraph 4 of art. 35 of the same law, regarding state lotteries.

According to Fux, the Union “cannot establish privileged treatment to the detriment of the member States, under penalty of violating the provisions of article 19, III, of the Federal Constitution, and the federative principle”. The minister also stated that “the exclusive legislative competence of the Union for the matter does not exclude the material competence of the States to operate lottery services; The States have material competence to provide all public services that are not expressly prohibited by the Constitution”.

Thus, the ruling of the Supreme Federal Court confirmed the constitutionality of the States to explore and regulate their lottery activities, ensuring the operation of the modalities authorized by law.

The ADI 7640, was presented by the governors of the states of Acre, Federal District, Mato Grosso do Sul, Minas Gerais, Paraná, Piauí, São Paulo, and Rio de Janeiro, challenging provisions of the Fixed Quota Sports Betting Law. The governors challenged the provisions of the law that restrict the operation of the lottery service within the states and the Federal District.

The governors stated that the law enacted last December, which amends parts of the 2018 law, restricts the same economic group from obtaining concessions to operate lottery services in more than one state. Additionally, it prohibits advertising in states where the lottery service is not operated.

According to Minister Luiz Fux, the Union, in legislating on lottery services, cannot benefit at the expense of the states, creating distinctions between the federative entities and highlighted that the norm prevents the states from fully exercising their competence to operate lottery services, by limiting the participation of companies and economic groups in tenders.

The trial, which was taking place in the Virtual Plenum of the STF, was suspended at the request of Minister Gilmar Mendes. The trial was supposed to end on October 25, but will now resume after the minister has reviewed the case.

With more than 1,300 representatives from operators attending, the event promises to be a platform to foster partnerships and gain insights into the growth potential of the region.
