The public lottery service of the Municipality of Sorocaba (SP) was created, allowing the exploitation of any of the lottery modalities provided for in federal legislation. This is established by Law No. 13.126, of January 17, authored by councilor Cláudio Sorocaba (PSD), published in the Municipal Journal.
The law provides that it is up to the Executive Power to exploit the public lottery service directly or indirectly, through concession, permission, or authorization.
The norm also determines that the net revenue from the commercialization of lottery products will be primarily allocated to the areas of education, health, social assistance, culture and leisure sports, and urban infrastructure.
In the justification of the law, Cláudio Sorocaba emphasizes that the objective is to create a new source of revenue dedicated to priority areas of public service. The author highlights that the initiative is in line with the decision of the Supreme Federal Court (STF), which, in 2020, recognized the competence of states and municipalities to exploit lottery services, provided that the modalities provided for in federal legislation are observed.
Law No. 13.126 was promulgated by the president of the Municipal Chamber, councilor Luis Santos (Republicans), and affixed in the atrium of the House of Laws, in accordance with the provisions of § 8 of Art. 46 of the Organic Law of the Municipality of Sorocaba, and § 4 of Art. 176 of Resolution No. 322, of September 18, 2007 (Internal Regulations).
It will be up to the municipality of Sorocaba to define how the lottery will be tendered to the private sector.
